“As stated in your petition, FSIS does not identify a poultry item with the head remaining intact as a product or service qualified to bear the mark of inspection. Because the head stays intact, the solution defaults to the exempt item category.

“The petition states that the Chinese Young Goose with Head solution produced by your corporation satisfies the actual physical description of selected spiritual exempt goods but that labeling the merchandise as spiritual exempt would be phony and would not accurately reflect the genuine product in the deal.

“According to the petition, maintaining the head intact by shifting the 9 CFR 381.1 definition is essential to clear away a barrier to merchandise development.”

The petition requests that FSIS amend 9 CFR 381.1 to change the Completely ready to Cook dinner Poultry definition to include partial dressing of a carcass as approved by the Secretary if the producer demonstrates that there is a market for the products and that the carcass can pass a put up-mortem inspection.
